Ginsburg Temporarily Blocks The Chrysler Deal

With minutes to go before a 4 p.m. deadline today, Justice Ruth Bader Ginsburg put a hold on the takeover by Fiat that Chryler needs to save it from collapse. The general expectation seems to be that the delay will be brief. Why does the Supreme Court need more time to consider it? At SCOTUS blog, veteran reporter Lyle Denniston speculates:

* Ginsburg may have decided to share the decision on what to do with her eight colleagues, and they needed more time to think or talk about it.

* Members of the Court may have decided that they wanted to give some explanation, or perhaps some may have decided to dissent and wanted a chance to prepare a statement saying so. In the meantime, it was her task, as the Circuit Justice, to impose a limited stay.

* Ginsburg or the Court may be waiting to see how the Second Circuit explains its decision to uphold the terms of the sale. The Circuit Court issued no opinion on Friday, indicating that such an explanation would come “in due course,” although the expectation was that one or more opinions would emerge from those judges on Monday.

    KT: The pension funds that want a review belong to the police, teachers and other working groups. Perhaps Justice Ginsburg wants a wider discussion. The trouble with this is that Fiat now has an excuse to withdraw if it chooses to do so. This looks bad for Chrysler.

    In the end, if the court upholds the objections, everyone will lose, including the bond holders.

    I have a prediction. Due to a combination of political interference from sitting GOP senators and congressmen, conservative media personalities (rushbo), and the help of the hold out creditors and their lawyers, both Crystler and GM will end up being liquidated. Chapter 7. Gone. And the GOPs name will be MUD in the midwest for the next 40 years.

    KT: As I said in the prior thread, the SCOTUS blog coverage is infinitely better than the Bloomberg coverage. As long as any post-journalism apocalypse doesn't kill off blogs hosted by experts, I'm not too worried.

    northernobserver: Over beers at a graduation party this weekend, the word from an accountant friend of a neighbor is that in the next 3 months we will be treated to about 100(!) automotive suppliers filing for bankruptcy (Visteon and Metaldyne already announced shortly after GM filed).

    The interfering GOP senators and congressmen will get to watch as their vaunted transplant car factories have to lay off workers, en masse, as clips, nuts, bolts, steering wheels, transmissions and air conditioners are no longer available.

    Governor Jennifer Granholm's poll numbers have improved in the last 6 months (missing NPR link - heard on the radio today), a good sign that the GOP is MUD in Michigan in 2010.

    I don't think that Chapter 7 is in the cards, but unions across the country are watching to see how DC treats the autos.

    Ah, yes, indeed...

    If I recall correctly, during the immigration reform bill in 2007 Murtha, acting in capacity as Speaker, allowed Democratic votes to be switched after the gavel had sounded an end to voting. Republicans calling for a point of Parliamentary inquiry were ignored repeatedly....

    But, there are numerous incidents where the Majority Leader does not preside over votes, I recall numerous occasions when others, such as Murtha, have acted in that capacity for a day.

    I suspect that NY State is like Illinois in that the State legislature is highly polarized between City Democrats and Up(Down)State Republicans.

    In any event, its a local story and since it doesn't even reflect an election result, it's probably not going to generate too much interest beyond the region.

    Slippery roads tend to cause accidents. The current trend of the Obama Administration to interfer into the free market process is now going to bite him, and severely cause damage to his socialist soul.

    With that said, Ginsberg et al will review and find how un-constitutional all of the bailouts and stimulus bills have become under Obama. His all powerful persona will be held out for public view so that we can see his intentions were only for political reasons. He is creating a socialist country all for the sake of providing mass millions of dollars as payback to the Unions for their vote in November. This will fall down like a house of cards.

    I am giddy over the prospect of finally seeing Obama being held accountable for the complete mess he has made out of all of our economic whoas. Especially when in my own small local newspaper they are reporting how he can take his "wife on a date" to NY at tax payers expense. We will see shortly that jobs are continuing to be lost. The unemployment rate will shatter 11%. People will see the "change you can believe in" is really political payback, and their world is nothing more than progressive ideals gone wild on Obama crack.

    The house of cards has already fallen. It was known as our economy which pretty much existed on paper only and watched over by no one.

    As we know this didn't happen over night but was the result of years of greed and fraud. All the early warning signs starting with Enron and WorldCom were quickly forgotten as soon as we got a few people in jail because we could not wait to start making a bunch of money again.

    I wouldn't be surprised if that socialist, wife-dating cad (Obama) tries to divert attention away from his crimes by putting the heroic members of the previous administration on trial for trying to protect us terrorists.
