Blago v. Reid

Harry Reid has warned that the Senate will not seat anyone appointed by disgraced Illinois Governor Rod Blagojevich. Now comes word that the Governor has picked former Illinois AG Roland Burris, who would be the only African-American in the Senate:

Shortly after Obama's Nov. 4 victory, Burris made known his interest in an appointment to the Senate but was never seriously considered, according to Blagojevich insiders. But in the days following Blagojevich's arrest, and despite questions over the taint of a Senate appointment, Burris stepped up his efforts to win the governor's support.

Though he is 71, Burris has said that Obama's replacement should be able to win re-election and he has noted that despite a string of primary losses in races ranging from Chicago mayor to governor and U.S. senator, he's never lost to a Republican.

Blagojevich, who has sole authority to name a replacement senator, scheduled a 2 p.m. news conference at his downtown Chicago office.

Blagojevich's criminal defense attorney Ed Genson had said Blagojevich would not name a Senate successor to Obama. The governor had indicated he agreed with other Illinois politicians that the best option might be a special election to fill Obama's seat. But state lawmakers have not taken up the necessary legislation.

Um, classy...

UPDATE: One source close to all this notes that Secretary of State Jesse White has said he will not certify any appointment by Blogojevich, which may be a way to block it. Meanwhile, the Senate Democratic leadership issued this statement, through the office of Senate Majority Whip (and Illinois Senator) Dick Durbin:

“It is truly regrettable that despite requests from all 50 Democratic Senators and public officials throughout Illinois, Gov. Blagojevich would take the imprudent step of appointing someone to the United States Senate who would serve under a shadow and be plagued by questions of impropriety.  We say this without prejudice toward Roland Burris's ability, and we respect his years of public service.  But this is not about Mr. Burris; it is about the integrity of a governor accused of attempting to sell this United States Senate seat.  Under these circumstances, anyone appointed by Gov. Blagojevich cannot be an effective representative of the people of Illinois and, as we have said, will not be seated by the Democratic Caucus.

“Next week we will start one of the most important debates of the year – outlining an economic recovery plan to create jobs and invest in America.  And in the coming weeks, we will be working to protect homeowners and consumers, make America more energy independent, strengthen our national security, and improve health care and educational opportunities. There is much work to do and a lot at stake.  It is thus critical that Illinois and every other state have two seated Senators without delay.

“We again urge Gov. Blagojevich to not make this appointment.  It is unfair to Mr. Burris, it is unfair to the people of Illinois and it will ultimately not stand.  The governor must put the interests of the people of Illinois and all Americans first by stepping aside now and letting his successor appoint someone who we will seat.”

    I think Blago has major league chutzpah. That said may be able to extricate himself from these federal charges of cash for appointment, if he makes this appointment.

    Fitzgerald hasn't had a grand jury return an indictment nor has there been a preliminary hearing. Wouldn't this appointment weaken his case?

    Blagojevich must think Burris is a magic negro, and not subject to Reid's warning. That's going around.

    Shouldn't be a shock that Blago would go against his previous word and thumb his nose at the state legislature, Fitzgerald, and even the U.S. Senate.

    Now the question becomes what happens to Burris. Will he ever get seated by Reid and Co. in D.C.? Maybe the past differences with Blago and his connections to Obama will help him get past the PR bluster and actually allow Illinois to have a second Senator.

    Reid is a fool. Here's Reid's M.O.:

    1. Draw line in sand.
    2. Watch as line is crossed.
    3. Capitulate to line crosser and declare outcome "best under the circumstances."

    Given the above, I think it is fairly predictable how this will play out.

    All Blagojevich has to do is swat Reid on the nose with a rolled-up newspaper and Reid will appoint whoever Blago wants. Hell, he should talk to Palin and a work out a deal to get Bristol into office this way.

    I think it's great that Blago is creating headlines on what would normally be a slow news week. Fitzgerald is having a conniption, Obama has cut himself opening a can of Spam, and the editors at the WSJ and Fox news channel are having an orgasm.

    Govenor Patterson must be thrilled that Caroline Kennedy is out of the headlines for a couple of days.

    Andy, people in your office are probably used to you laughing out loud to no one. What they really are wondering is, "Is he armed this time?"

    At this point the smart money is on Patterson to now make his move and appoint Kennedy under the cover that the Blago appointment controversy will no doubt provide. Did Patterson call Blago and arrange this cover?

    I guess the term Magic Negro takes on a new meaning now?

    @sqr1: You are exactly right. Using his fool-proof M.O. is how Reid managed:
    - to get Lieberman kicked out as chair of the HS&GA committee,
    - to pass an Auto Bailout Bill, and
    - to pass a Wall Street Bailout Bill.

    Nothing like having one's back against the wall to help a scoundrel Do The Right Thing. According to TPM, Burris's resume looks pretty good. Blago may have wom a few Brownie Points.

    As for Reid does he really have the power to prevent Burris from being seated? Because I can see this scenario unfolding. Reid says they won't seat Burris as a Democrat. Mitch McConnell being the conniving dirt bag that he is says he will welcome Burris to the dark side with open arms. Reid falls all over himself tryinng to woo Burris back to the Dems and seats him post haste never realizing that McConnell was never serious in the first place.

    At least that is what would normally happen when Harry Reid draws a line in the sand.
